The use of controlled substances or alcohol is inconsistent with the behavior expected of employees, and subjects fellow employees and visitors to unacceptable safety risks. Neither federal nor state law prohibits employers from disciplining or terminating employees for marijuana use, even when the drug is used to treat a disability in accordance with California’s medical marijuana law. Although marijuana is now legal in California, it is still illegal under federal law. The Controlled Substances Act lists marijuana as an illegal drug, even if used for medicinal purposes.
